Terms
These Terms of Use govern your access to and use of Conscious Heart, including our mobile applications, websites, and related services. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account Responsibility
You must be legally allowed to use the Service under applicable law. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Service Nature and Important Disclaimer
Conscious Heart provides meditation, journaling, emotional reflection, and AI-assisted features. Conscious Heart is not a medical, psychiatric, psychotherapy, crisis response, legal, or financial service.
The Service and all AI outputs are provided for informational and self-reflection purposes only. AI outputs may be inaccurate, incomplete, or unsuitable for your circumstances. You are responsible for decisions made based on the Service.
If you are in danger, have thoughts of self-harm, or are experiencing a mental health emergency, contact local emergency services or a licensed professional immediately.
3. Subscriptions, Billing, and Trials
Paid features may be offered through Apple In-App Purchases and other supported billing channels where applicable. Pricing, trial periods, renewal, cancellation, and refunds are governed by the rules and policies of the relevant platform provider and applicable law.
Unless canceled in accordance with platform rules, subscriptions may automatically renew.
4. Privacy and Data Processing
Our handling of personal data is described in our Privacy Policy. By using the Service, you acknowledge that your data may be processed as described there.
To provide AI-related features, certain content may be processed by third-party service providers, including providers such as OpenAI and Hume AI, subject to their terms and privacy practices.
5. User Content and License
You retain ownership of content you submit to the Service, including journal entries, chat input, and related materials.
You grant Conscious Heart a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your content solely as necessary to operate, maintain, secure, and improve the Service, and to comply with legal obligations.
You represent that you have all rights necessary to submit User Content and grant this license.
6. Acceptable Use
You agree not to:
- violate any law or regulation;
- upload unlawful, infringing, abusive, hateful, or harmful content;
- interfere with, attack, reverse engineer, or disrupt the Service;
- bypass subscription, quota, access, or security controls;
- use the Service for fraud, harassment, surveillance abuse, or exploitation.
7. Consciousness Map and Community Features
If map or community features are enabled, Conscious Heart may display selected indicators, such as AQ-related levels or top categories, according to product settings and consent controls.
Conscious Heart does not intentionally publish private raw journal text in public map views.
8. Intellectual Property
Except for User Content, the Service and its components (including software, designs, text, graphics, trademarks, and branding) are owned by Conscious Heart or its licensors and are protected by applicable intellectual property laws.
No rights are granted except as expressly provided in these Terms.
9. Third-Party Services and Links
The Service may include integrations, content, or links to third-party services. We do not control and are not responsible for third-party services, content, policies, or practices.
Your use of third-party services is governed by their terms.
10. Suspension and Termination
We may suspend, restrict, or terminate your access to all or part of the Service if we reasonably believe you violated these Terms, created legal or security risk, or where required by law.
You may stop using the Service at any time.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law, Conscious Heart and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenues, goodwill, or business opportunities, arising out of or related to your use of the Service.
Where liability cannot be excluded under applicable law, liability is limited to the minimum extent permitted by law.
Nothing in these Terms limits non-waivable consumer rights under applicable law.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Conscious Heart and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your violation of these Terms.
14. Changes to the Service or Terms
We may modify these Terms and the Service from time to time. If we make material changes, we will provide notice through the Service or website as appropriate. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by applicable law in your place of residence, unless mandatory law requires otherwise.
Any dispute arising out of or relating to these Terms or the Service will be resolved by the competent courts required by applicable law.
16. Severability and No Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Any failure to enforce a provision is not a waiver of that provision.
